Unwed mothers can be sole guardian of child: Supreme Court

New Delhi: In a landmark judgement, the Supreme Court of India on Monday ruled that unwed mothers can be given sole guardianship of a child and there is no need for consent of the biological father of the child concerned. Supreme Court of India

A Supreme Court bench headed by Justice Vikramjit Sen said this while setting aside earlier order of a lower court. The court said that the lower courts, including high court, lost sight of the issue that was before them to be examined and decided the matter without taking into account the welfare of the child.

The court order came while hearing a petition by a woman who had challenged the procedural necessity of stating the identity of the biological father and issuing notice to him on a plea seeking sole guardianship of the child by the unwed mother.
